Today, President Biden issued an Executive Order ("EO") to raise the federal minimum wage to $15 per hour for certain federal contractors by January 30, 2022.
Under Section 8 of the EO, the $15 per hour minimum wage will apply to any "new solicitation," "new contract" and "new contract-like instrument" (as well as extensions, renewals, and options for existing contracts or contract-like instruments) for, among other things, services contracts, construction contracts, and for services covered by the Service Contract Act. The EO also eliminates, by 2024, the tipped minimum wage for federal contractors (i.e., so that tipped employees will earn the same minimum wage as other non-tipped employees on federal contracts).
